10. If the parties hereto, or any of them, hereto or assigns shall violate or attempt to violate any of these covenants, restrictions, provisions, or conditions herein, it shall be lawful for the VanBibber Lake Property Owners Association, Inc. Board of Directors, or any other member owing real estate situated in this section to prosecute any proceedings at law or at equity against the person or persons violating or attempting to violate the above conditions. It shall be lawful to collect for any damages or dues for such violations.

11. These covenants are to run with the land and shall be binding on all parties and all persons claming under them until December 31, 2015 at which time said covenants shall be automatically extended for successive periods often (10) years or unless a vote of a majority of the membership in good standing of the VanBibber Lake Property Owners Association, Inc. or its successor or assigns.

12. Invalidation of any of the forgoing covenants, provisions, restrictions, or other conditions by judgment or court order shall in no way affect any of the other provisions, which shall remain in full force and effect.

This completes the restrictive covenants changes. As a quick review let's look at the changes:

In several areas requirements of getting written approval and building permits was added. Checking with utilities for easement restrictions and building across property lines. Business's operated within the community. Dog requirements and restrictions, lake access and fencing limitations. Dock construction requirements. Levying fines for violations.  Moving  existing structures and homes. Addition of stick built homes. Foundation requirements. Moving campers in and out and changes in minimum square footage requirements.

 

VOTING:

These changes came about through the combined effort of the past 3 Board of Directors, several members of the community and comments and letters from concerned property owners. For those of you that have paid your POA dues and are currently a member in good standing you will find enclosed a ballot and a self-address envelope. Please take a few moments and vote by following the instructions on the ballot. For those of you who did not receive a ballot it is not to late to vote. If you come in the POA office before the May 28th Semi-annual Members Meeting and pay your dues in full you can cast your ballot at the office. The results will be announced at the Members Meeting.


SPRING TIME CLEAN-UP

Once again spring is here and we all need to do some spring-cleaning. The POA will have a spring clean up weekend on May 21st and 22nd. There will be a dumpster available for those items that you cannot put out in the regular trash pickup. Please do not bring your everyday trash to the dumpster. With 500 households in the area the dumpster will fill up fast enough.

UNLICENSED VEHICLES

If you currently have an unlicensed vehicle on your property or in the roadway, please contact one of the following individuals and they will remove it at no cost to you.

The POA will be sending out letters to those properties that currently have an unlicensed vehicle. You will have 30 days to dispose of the vehicle. If the vehicle is not removed from the property after 30 days the POA will authorize its removal.

UNKEMPT PROPERTY

There are several properties that are in need of cleaning and/or removal items such as refrigerators, sofas and other household items, trash, parts of lawn mowers, golf cart parts, etc. This is unacceptable and needs immediate attention. If these properties remain unkempt after the May 21st Clean-up weekend, the POA will notify the property owner. If the property is not cleaned up properly the POA will step in and clean it. All expenses for the clean­up will be bore by the property owner.

The number one complaint the POA receives has to do with property maintenance. We realize that some owners don't have a lot of money. However there are no excuses for unkempt property, it does not cost anything to keep your property neat and clean.

DOGS RUNNING LOOSE

There are a number of dogs running loose in the community. If your dog is caught by security the POA has authorized him to remove the dog and any costs incurred will be bore by the owner. The dogs will be sent to the Putnam County Animal Shelter.
